When parents are unable to care for a child, someone must step in to provide care. 

There are various instances when a child’s parents may be unable to provide care for their child, such as death, serious illness, drug addiction or substance abuse, serving in the military, or serving time in jail. By default, parents have the legal obligation to provide care and the legal rights to make decisions. In these instances, the child needs someone other than their parent to provide them with housing, food, and clothing, and to enroll them in school and make sure they receive necessary medical treatment.

  • A guardianship is a court proceeding where a judge appoints a responsible adult other than the parent to have full legal and physical custody of a child (age 17 or under) and/or to manage their finances.

  • A guardian has the same legal rights as a parent and full decision-making control. The guardian is also responsible for providing housing, food, and clothing to the child, and enrolling them in school, as well as making sure all their medical needs are met. A guardian can also be granted the authority to manage the child’s finances.

  • Possibly not. It may be sufficient to have the parents sign an agreement giving you custody of the child and granting you the authority to make decisions about their education and medical care. The parents can cancel this agreement at any time. 

  • You may be able to use a Caregiver’s Authorization Affidavit, but you should consult with an attorney to make sure this agreement is sufficient for your needs.
